One of the biggest challenges that comes with providing notary public services is understanding the different and varied legal and notary requirements that exist in countries from all over the world. They are as much the same as they are different.

We are very fortunate to handle such a high volume of notary work that over time we have become more and more familiar common documents (for example, power of attorney, life certificates, renunciation of citizenship, divorce papers and affidavits) used in other countries. Through our clients and their notary requirements, we begin to understand the notary requirements for each country and their respective foreign office operates. Surprisingly, the nature of notarisation and what is considered acceptable for each country can be different and sometimes vary greatly.

If you reside in Australia and you need to send documents overseas, it is likely that you will need to have those documents notarised. We encourage you to consider the following couple of points when considering to engage our notary services:

  • We will always provide you with a range of options to identify what is the most cost effective and practical solution (which is sometimes not to notarise documents at all), and what is the most appropriate solution for you in the your situation.
  • If you do not know what the requirements are, find out. Do not guess! Unfortunately, many of our clients do not know why they need to have a document notarised, or what that document is intended to do. That is very risky. Generally, a documents that needs to be notarised would probably be important or have some sort of legal or financial consequence. If you are not sure what it does or why it needs to be notarised, make some quick enquiries with the appropriate people or organisations to clarify the notary requirements. Make sure that you get it right, because it might be a lot more expensive if you get it wrong.
  • Consult your foreign lawyer or the foreign office of the intended destination country. In both cases, we expect that their advice is the most relevant to you since you will eventually be using the notarised document within their country or jurisdiction.
  • Ask for clear written instructions or a checklist with the specific requirements so that you know what you need and we know what you need. Following the instructions should mean that there will be no issues or problems once the notarised documents arrive at the intended destination country.
