In most cases, we recommend that our clients arrange for the power of attorney to be prepared by a lawyer in the intended destination country, as this generally ensures that it would be legally valid and can be used in that country.
For clients with legal, property, or business dealings in the Slovak Republic (also known as Slovakia), the power of attorney is called a “Splnomocnenie” and with that document they can appoint an attorney, also known as “splnomocnenec“, to handle all matters on their behalf.
By the time you are reading this article, you have probably been searching the internet information and you would have also found various forms, templates, and different versions for different purposes. Despite the power of attorney or splnomocnenie being a fairly basic and straightforward document, it is an important legal document. It is more dangerous and risky to rely on a document that you download from the internet rather than rely on legal advice and assistance from a lawyer in the Slovak Republic. Ultimately, if you are involved in legal, property, or business dealings in the Slovak Republic, then it is also likely that there will be a lawyer involved to assist you or to assist your attorney or splnomocnenec with whatever you need to do over there – that should be the lawyer who would prepare the splnomocnenie for you to ensure that it is valid in the Slovak Republic and it can specifically achieve what you want or need it to achieve (rather than just some generic document for some irrelevant purpose).
If signed in Australia, splnomocnenie must be notarised and stamped with an apostille from the Department of Foreign Affairs and Trade (DFAT) since the Slovak Republic, like Australia, is a member of the Apostille Convention. In most cases, we assist clients with the notarisation and we also arrange for the apostille from DFAT. It just makes things easy for clients and avoids them having to deal with the hassle and uncertainty of handling unfamiliar processes, especially when this is something that we do all the time.
