Legal action in Australia against parties in Malaysia

There is no convention, treaty or other agreement between Australia and Malaysia for serving process in Australian civil legal action against parties in Malaysia.

The Malaysian Government will not accept requests through the diplomatic channel for assistance through the Malaysian authorities. Service is best achieved by appointing a private agent in Malaysia to serve Australian court documents on parties in Malaysia. There is also no convention, treaty or other agreement between Australia and Malaysia for enforcing civil judgments.

Sale and Purchase Agreements

The Borang 14A/16A, surat akuan or any other documents written in Malay do not require translation into English to be witnessed and notarised in Australia.

Be careful. Many other notaries may not fully appreciate the formalities required by the land registry office in Malaysia.

We ensure that all documents are only signed in black ink as required, Also, we have a separate set of stamps made in black ink just for documents intended for Malaysia.

Appointments outside normal business hours at the Phang Legal office in Parramatta, ‘home/office visit’ by a mobile notary, or requests for immediate or urgent services are available on request (additional fees will apply).
